Terms of Service
Last updated: October 27, 2026
The short version
- 1 credit = 1 AI image. Images that fail are refunded as credits automatically.
- You keep the rights to what you upload, and you can use the thumbnails you make, including commercially.
- Only upload photos you have the right to use, and follow the content rules below.
- Subscriptions can be cancelled any time. Refunds are explained in the Refund Policy.
1. About these terms
These terms are an agreement between you and ViralThumbnail ("we", "us"), the service at viralthumbnail.app, operated from Mexico. They cover the website, the web app and the ViralThumbnail Chrome extension. By creating an account or using the service, you accept these terms and our Privacy Policy.
2. Your account
- You must be at least 18 years old, or the age of majority where you live, to create an account or buy credits.
- Give accurate information and keep your password safe. You're responsible for what happens under your account.
- An account is for one person or one channel team. Don't create accounts to collect extra free credits.
3. Credits and payments
- What a credit buys. One credit makes one AI image: a new thumbnail, a retry, an edit (refine) or a feedback fix. Planning concepts and changing the headline, font or text size are free, within daily limits.
- Automatic refunds. If an image fails to generate, or our safety check refuses the request before the image is made, the credit is returned automatically. If a finished image is blocked by the safety check on its output, the credit is not returned, because the image was produced.
- Prices. Prices are shown in US dollars before you pay. Payments are processed by Stripe; your bank may add currency-conversion fees.
- Subscriptions renew every month and add their credits with each payment, until you cancel. Cancel any time from Manage subscription in the app: the subscription ends at the end of the period you already paid for. We'll tell you at least 30 days before a price change for your subscription takes effect.
- Credits have no cash value, can't be transferred or resold, and don't expire while your account is open.
- Refunds and chargebacks. See the Refund Policy. When a payment is refunded or disputed, the credits it added are removed, and your balance can go below zero.
4. Your content
"Your content" means what you give us: photos, product or scene images, video frames, titles, notes and instructions. You keep all rights to it. You give us permission to store, process and send it to our service providers only to provide the service to you (for example, to generate and screen your thumbnails). We don't use your content to advertise, and we don't sell it.
You confirm that you have the rights to everything you upload, and the permission of any person who appears in your photos.
5. The thumbnails you create
- As between you and us, you may use the thumbnails you create for any lawful purpose, including commercially on your channel.
- We don't keep your thumbnails or photos. Download the thumbnails you want as soon as they're ready: they're deleted 1 hour after your last action, or sooner if our server restarts, and can't be recovered.
- Thumbnails are made by AI. Other users may get similar results, and we can't guarantee that an image is unique or free of third-party rights (for example, a logo or likeness that appears in it). AI can also make mistakes in faces, text or details. Review every thumbnail before you publish it.
- You're responsible for following YouTube's policies when you publish. ViralThumbnail is not affiliated with or endorsed by YouTube; YouTube is a trademark of Google LLC.
6. Content rules
Don't use ViralThumbnail to create or upload:
- sexual content involving minors, or any sexualized image of a real person without their consent;
- content that harasses, threatens or promotes hatred against people or groups;
- deceptive images of real people meant to mislead (deepfakes), or impersonation;
- content that infringes someone else's copyright, trademark or privacy;
- anything illegal, or that promotes violence, self-harm or dangerous activities.
Also don't try to get around our safety checks, overload the service, scrape it, reverse-engineer it, or resell access to it. Our automated safety checks screen text and images and may refuse a request; they can sometimes be wrong. If you think a refusal was a mistake, write to support@viralthumbnail.app.
7. Services we rely on
We use Google Cloud (hosting and AI models), Google sign-in, Stripe (payments) and YouTube's public feeds (to show your channel's recent thumbnails). Their own terms apply when you use them directly, for example when you pay on Stripe's checkout page.
8. Availability and changes to the service
We work to keep ViralThumbnail available, but it may sometimes be down, slow, or change as we improve it. If we ever close the service, we'll tell you at least 30 days before, and refund the unused credits you paid for.
9. Suspension and closing your account
You can stop using ViralThumbnail at any time, and ask us to delete your account by writing to support@viralthumbnail.app. We may suspend or close an account that breaks these terms, abuses the service or commits payment fraud. Credits on an account closed for breaking these terms are not refunded.
10. Disclaimer and limit of liability
To the extent the law allows, the service is provided "as is", without warranties about results (for example, views or click-through rates), and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. We aren't liable for indirect losses such as lost revenue or lost data. Nothing in these terms limits rights you have under consumer protection law that can't be waived, including the Mexican Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).
11. Changes to these terms
We may update these terms. For important changes, we'll tell you by email or in the app before they take effect. If you keep using the service after that, the new terms apply.
12. Governing law
These terms are governed by the laws of Mexico. If you're a consumer, you can also contact the Federal Consumer Protection Agency (PROFECO), and you keep any right to bring a claim in the courts where you live.
